Conditions

CONDITIONS OF PARTICIPATION

Outdoor activities in a water environment may carry attendant risks. Participants must be aware of and accept these risks and be responsible for their own action and involvement. Unfortunately, due to safety considerations Black Boats Ltd cannot take participants who are unable to understand these terms or to follow instructions given in English or Welsh.

Accidents can happen without any contributory negligence from the Black Boats Ltd or its staff. Black Boats Ltd can accept no responsibility for loss or damage to personal property or for personal injury not arising as a result of its own act or default.

All sessions are staffed by appropriately qualified guides in accordance with the Black Boats Ltd. Health and Safety policy. Trainees will be supervised by a qualified guide at all times.

Whilst every reasonable attempt will be made to deliver sessions Black Boats Ltd. reserves the right to cancel or modify the session due to safety considerations or factors beyond our control, such as weather, sea conditions, tides, etc. This also includes the instruction of Clifden eco-Camping.

As part of the continual review of safety and associated considerations, the conditions of booking are subject to change, clarification and modification at any time only by the Head Guide.

All persons signing will have associate day membership of the Association of Awesome Human Beings*.                                                                * This doesn’t really exist, but it should.

Liability and Insurance

All participants must be aware that outdoor activities are potentially dangerous and accept the risks associated with these activities.

Black Boats Ltd. is under no liability whatsoever in respect of loss or damage to property, however caused, whilst participating in a currach tour.

Black Boats Ltd. holds public liability cover.

Health and Safety Considerations

Due to the strenuous nature, all participants must be physically able to participate in sessions. Anyone with a medical condition or injury which may impede their ability to participate should consult their medical practitioner to assess their ability to participate. The guide must also be informed of any pre-existing medical conditions, injuries or allergies.

Disabled persons and those with restricted mobility may be able to participate in sessions, subject to submission of details at the time of booking and to the approval of the Head Guide.

While participants do not need to be able to swim, they do need to be comfortable in and around open water wearing a buoyancy aid.

All participants must be at least 5 years old, and those under 16 must be accompanied by a responsible adult and all under 18 must have full parental consent.

Spectacles can be a hazard to you whilst participating in sessions. If you choose to wear spectacles you must accept that injury may occur and accept full responsibility for any such injury. Participants must also accept the risk of loss. Participants may wear contact lenses.

** Black Boats staff reserve the right to refuse participation to anyone considered to be under the influence of alcohol or drugs.

** Black Boats staff may require any participant to leave the session if that person acts in any manner as to endanger him/herself, any other Black Boats Ltd. guest or member of staff.

Appropriate Image Use

Black Boats Ltd. recognise the need to ensure the welfare and safety of all young people. Whilst taking part in an activity, participants may be photographed by Black Boats Ltd. or their approved agents. These images may be used for promotion by Black Boats Ltd. If this is not acceptable please contact Black Boats Ltd. at any time. Your wishes will be respected.

In accordance with our child protection policy and procedures, we will not permit photographs, video or other images of children/young people to be used without the consent of the parents/carers and children/young people. We will take all possible steps to ensure these images are used solely for the purpose they are intended. If you become aware that these images are being used inappropriately you should inform Black Boats Ltd. immediately.
